Johnny Awesome:Oh man, it has been. It's been a long time since we've actually been in the same room together. It has been like this feels weird. Yeah, it's like we went out on our first date like four months ago and we haven't talked since.
Jimmy Fantastic:Yeah, cause it was a weird, we held hands. Yeah, now we're back together.
Johnny Awesome:Oh, both Jimmy and.
Jimmy Fantastic:I are both. We're both fighting the plague.
Johnny Awesome:Yeah, so I've had it for for what seems like forever now. And good morning, Lisa. How are you? Good morning. I have had it for what feels like forever, and I mean it was bad this time around it. It knocked me out. I was on my back Like there was, I couldn't even get out of bed, right, and it was bad.
Jimmy Fantastic:So well, that's, that's what I had, and my wife and I both had it like before we went to Vegas, right? Before we went to and then and then I, I thought I was recovered, but then you know Vegas yeah it doesn't help. Look, you're sick, miss. Yeah, no, it didn't help. No, not one bit.
Johnny Awesome:So today's, the today's show. You might hear a couple coughs in between Um you. We definitely aren't at a hundred percent duck off camera. Yeah, there it is. Dude, that's going to be rough man. My voice is completely shredded, but we do. It's nice to be back, though.
Jimmy Fantastic:It is, it is.

Jimmy Fantastic:I missed it Looks good. Yeah, we haven't been in here forever either. No, if we can have people, stop taking stuff out of here.
Johnny Awesome:Yeah.
Jimmy Fantastic:The announcement if you can stop taking stuff out. If you guys could stop removing stuff out of our room, that'd be great. I don't know why. And again, like the things that get moved are the weirdest thing. I don't like I'm, I don't know why they would get moved, Like the equipment stays here and that's fine.
Johnny Awesome:It's like kids. It is when you tell it like here's all their toys, right, like they're all over there in that room, and then you have that one thing, like like your pen, that's like a fountain pen, and you're like you can tell Well, it's like it's human nature, right, you have tired garden. There's one tree you can't eat off of. Yeah, I'm going there, yeah.
Jimmy Fantastic:I'm going to eat up that tree, for sure.
Johnny Awesome:That's where I'm going. Give me the fountain pen.
Jimmy Fantastic:Yeah, that's why, like you know and you know, we get this as as you and I get this as parents like it's really. You're constantly working on reverse psychology.
Johnny Awesome:Yeah, yeah. But you know, who's the best at reverse psychology is kids. Oh, yeah, yeah, we're the ones trying to like you don't really want to play with that. They're like yes, I do, yeah, I do Nope.
Jimmy Fantastic:You really don't want to stick your finger in that lights I can do it. Oh, yes, I do All right, doing it yeah.
Johnny Awesome:Yeah, it's fun stuff, so we're going to find stuff. As as always, we want to start off your morning. Good morning to those of you that are on the breakfast club as well. Jimmy Manning the board. You can hit star star and Jimmy will cue you up on the board. If you have anything that you want to add, ask, say, feel free to do that. Of course, jimmy Manning. Jimmy Fantastic:Yeah, it's a hundred percent chance. As soon as he gets a hundred percent chance.
Johnny Awesome:As soon as there's a 50, there's a 50% chance right now. There we go. We're good receiving calls, we are ready to rock and roll y'all. So interesting. Again, we want to start out the news hour. It's one of the reasons that we started. Uh, we extended the show but also started the show early, and this is really interesting. We've been talking a lot about for the last two years, it seems, jimmy, the whole NAR thing, and there's two things that we want to talk about today. Um, jimmy brought to my attention again I've been out of the loop for quite some time now Um, but Jimmy brought to my attention that there's a bunch of real estate agencies that are starting to pay NAR off, which is one thing that's really interesting. I found it very interesting a couple of weeks ago to find out that red fin is leaving and then telling all of its agents to leave NAR as well, which is causing a lot of other agents out there to be like down with NAR.
Jimmy Fantastic:Right, Like and what? What did you say before we went on? What does NAR do?
Johnny Awesome:Well, so it's interesting because you know, I remember, um, you know, I remember when we first started talking about this and they were talking about, you know, putting another government thing in place and we were taking a lot of calls on this. I remember people talking about, like you know, nar used to be in it. So it's one of those. It's another example, my opinion, okay, and if you guys love NAR, cool, I don't, I don't want to be anti NAR or whatever, but it's one of those, one of those examples again of some an organization that got together of people with the intent to do good for a certain group of people, right, but then they just got there, they got too powerful. And again, not I don't want to throw shade all over the place, but I kind of feel the same thing about real comp, our local MLS here, right, yeah.
Johnny Awesome:Personal opinion of Johnny. Right, the real comp they were originally, they worked for us, we pay them. But then somewhere along the lines are like oh no, no, no, you're going to follow our guidelines, you're going to follow our rules and our laws. Right, like they became the law all of a sudden.
Jimmy Fantastic:It's so weird how like they're like politicians work for us too, but don't. Then they tell us what to do, but we elect them to tell us what to do.
Johnny Awesome:Yeah, well, the other thing is is you know there's, and most agents don't even realize, like, yeah, they could have their hand in that because they just walk right. They don't realize that they can, you know, vote different things, that like be really involved with the politics side. But a lot of agents don't want to be that cause they don't want to be political, right? So, you know, redfin, you know, for those of you if I'm not sure if anybody listening is a Redfin agent, redfin is one of those. It broke it, just where everybody goes. Oh, I've known a guy, you know, I remember one agent.
Johnny Awesome:Yeah, here in Detroit it didn't work that good. They just never really picked up ground. But you know, down, like Texas and stuff like that, they take up a lot of. They do take up a lot of space down there. And it's just interesting because you know they they announced to all their agents like they want all their agents to remove themselves from NAR. And for those of you that are listening, you know you might not even remember there's other associations that aren't just the National Association, realtors, right? So once you leave and join one of those other associations, you can't use realtor anymore, right? Remember, because realtor is a trademark name for the National Association's of realtors, so this is going to get really interesting. What happens with that? What's going on with the whole buyer's agency thing that's coming out soon? So this is what we're going to be talking about during your news segment here for the next 30 minutes or so I see I see Jeff Garner's on over your recovering good buddy.
Jimmy Fantastic:He had foot surgery. Hopefully you're. Hopefully you're recovering well, Jeff. Left foot or right foot, I don't know, it was a foot, Okay.
Johnny Awesome:I thought you said it was a foot, it was. Oh, okay, I didn't, I got you. I can't hear you guys. My head, I'm, I, it's bad Turn your headphones up. But yeah.
Jimmy Fantastic:So so I was talking about this with Johnny this morning and he didn't realize, because he's been out of it Kind of what's been going on. But but anywhere, anywhere in remax have both paid off, paid NAR, it's like a mafia?
Jimmy Fantastic:It it is. But it was like they had to pay to leave. You want to mean like I wish, I wish somebody would pay me to leave. That'd be great, you know I, somebody would just give me. Like you know, here's a hundred grand. Don't ever talk to me again. Okay, sweet, it'd be great, that'd be awesome. But, but so anywhere they, so anywhere paid they. They paid 83 and a half million dollars in their commissions lawsuit. All right, and and then it was a move. Then it was a move what remax came right along after it, remax did a payout of $55 million. So I'm like this is a lot of freaking, like we're like this is a lot of money. Where is all this like then? Where does it go? What?
Johnny Awesome:do you mean? Where does it?
Jimmy Fantastic:go.
Johnny Awesome:Like, like, don't you remember, when you graduate your, your, your ethics class, you get that little realtor pin.
Jimmy Fantastic:Oh yeah, we get, we get paid for those. I got mine for free. Yeah, well, I'd misfigured like we had to pay for it Well, I well, we did.
Johnny Awesome:I don't remember $42 million, yeah.
Jimmy Fantastic:I don't remember how many things we paid for to become a realtor, but yeah, so. So anywhere paid 83 and a half million dollars. So now the terms of their settlement. Right, so they're the terms of the settlements. Nar membership is no longer required. Agents must clearly disclose that commissions are fully negotiable and not set by law. Yep, yep, so they're the term. Commission requirements.
Jimmy Fantastic:Yep, which means they can do zeros Well yeah, but yeah like who's yeah yeah, I guess right, you know, and remax, they did a $55 million settlement lawsuit and they said that the agreement is in no way acknowledgement of wrongdoing. Right no-transcript, but I'm like so then why pay the 55 million if there was no wrong doing? Well, that's, you know, that's, that's what they always do and say, right, like well, I got a speeding ticket and I paid it. You know, was I actually speeding or no?
Johnny Awesome:Part of it, though, that it just goes back to the legal type of system, though you know, part of it is like how much would it cost to continue to fight something, or you know how much? I don't know, man, there's. There's, since I've been watching suits like the rest of America, which I finished while I was on my deathbed, by the way. You know, I'm looking at, I look at stuff a little bit Now. I get it's a show, but there's legitimacy.
Johnny Awesome:I think they're there for sure and sometimes you know to settle and then get out of something is Is better than although. What do we know from suits like like what dirt? Didn't they want to be shown $22 million worth of dirt right there?
Jimmy Fantastic:Nothing happening. Look over here.
Johnny Awesome:Yeah right.
Jimmy Fantastic:But yeah. So remax, they said. We continue to believe our buyer agency, cooperative compensation and the idea that consumers are best served when they are working with real estate professionals.
Johnny Awesome:Yes, right, so that now notice what's interesting about that statement. Did you catch that last line?
Jimmy Fantastic:The Plants of consumers are best served when they're working with real estate professionals.
Johnny Awesome:Isn't that interesting? Yes, you know what they didn't say Realtors, right, isn't that?
Jimmy Fantastic:interesting. Yes, yeah, they didn't.
Johnny Awesome:Well, because they now they drop right to your point they can't say realtor, realtor guys, this is gonna get interesting real fast, yeah, especially cuz now, again, you know full disclosure. We're for everybody, we're a podcast for everybody, we're here to give you guys the news and stuff like that. Yeah, both Jimmy and I happen to be part of exp, right, and what's interesting about stuff like what exp is doing is like they just announced that that the internal system right, same thing with Keller Williams has been working on KW command forever. Yeah, so you know, so you've got, we're at this technology Company, we're at this interesting time. Well, everybody's a technology company. Now, I mean, you got you have to have some sort of technology with it, right. But what's interesting is, like you have all of these, all this stuff is kind of happening right now in this, this verge of where we're at in real estate. This is gonna get super interesting because, think about this, all these companies are getting fed up with NAR.
Johnny Awesome:Right, there's NAR's, whether they've done good for you or not. You know that's your personal opinion. Maybe you don't know all the stuff. You should definitely start looking into it. There's been a lot of crazy things that, for instance, redfin they dropped them because they didn't believe all the ethics were there. There were there's been allegations against heads of NAR that have looked the other way when when things have happened again we're not. You know you can go and look that stuff up and see what all that's about, but you know there's been a lot again. It's gotten really big, it's gotten really political and now the people are like wait a minute.
Johnny Awesome:Yeah why are we feeding this beast? Yeah, so now people are dropping, and they're doing this at the same time, that companies are rushing to figure out how to create their own internal systems. Correct, this is where this is getting crazy, and what I mean by that is all of these, all of these major companies like real estate companies right now Are trying to do their own internal. You know MLS systems, to start pulling away from the MLS as well, and now you even have here in Michigan, you know, a board that's doing this. And again, why? Because of there's a lot of political reasons.
Johnny Awesome:I can't wait until we can have that interview and that that one's coming up, I think, in January, and you guys wait till you hear this story, but we can't talk about it until January. I believe, is what we were told. But, like guys, there's so much political stuff happening that's causing people to take control of this stuff again and say no, no, we're, we're gonna go this way, in that way. So it's. We are living in an extremely crazy time right now for for real estate we are.
Jimmy Fantastic:And the funny thing about this article and I'm glad this was the article I did some research on, but NAR has said they have vowed not to settle. So although anywhere in remax have are paying them, nar is like no, no, no, we're not settling on this right. These proposed settlements do not change how its case will be presented in court. And it said, based on their latest filing, it appears that they are agreeing to do things already required by code of ethics, our MLS rules. So now remains committed to our guidance for local MLS broker marketplace that ensures Consumers get comprehensive, equitable and reliable home information and that brokerages of any size, service or price or pricing model Get a fair shot at competing. Yeah, okay. But so NAR is just saying, okay, cool, remax, you want to pay me fifty five million dollars? Great.
Jimmy Fantastic:Yeah, we're still going forward with the loss right. I appreciate you pay me, but you're still in this thing anywhere. You paid me 83 and a half million cool, we're still going forward with this, but I appreciate you paying my attorney fees for this. Yeah, you know, that's, and again it may sound crazy, but like going back to the suits thing, like Again, what dude what's happening up there.
Johnny Awesome:Like I said again, look for those of you that have not read redfin statement on this Google, redfin statement Against NAR, or or anything like that, and you'll read their letter. They talk about allegations that have come up against NAR, the reasons why they are telling their agents to leave. It's, it's been really, really crazy, jeff. Two things here. Good morning, robert as well. Again, if you're on the, if you're on the breakfast club, you can always chime in anytime you want by hitting star star. Jimmy is manning the board and watching for that. Also. Jeff is absolutely right. He says sharpen your skills, everyone. The week will not survive, but we will thrive, and that's. You know, that's part of it. Yeah, because what's gonna happen here? Because here's the deal, guys, and and we'll talk about this, you know, as we talk about building relationships, no matter which way, I mean, look how much real estate has changed. In the first place, jimmy, I forgot how long have you been licensed? You've been licensed like forever, right? Well, like ten years, okay, yeah, okay.
Johnny Awesome:So for some reason, I thought your license for no, you know, when I first got started in real estate, it was right in the like switch over of actual Having technology, like our office, when, when I first started at the blue circle company, there wasn't a, there was two computers in the entire place and, like, everybody shared it like they were precious.
Johnny Awesome:But we still had that room, the room, the up room, right when we would take calls in, and we still had the drawer next to us with all the listings they were stapled in Manila folders and we still had the drawer thing going on, right, and and it was crazy because, like I said, when I went in there and I was, and I, like they were, they were bragging that he just got Wi-Fi for everybody in the office, right, right, and it is weird because we were right when that technology started to break. But think about, think about where we went there, right, we went from Real estate where you had to go visit the realtor at his local office Because they had all the listings in the secret drawer, yep, and they're big book, the big book of business.
Johnny Awesome:Yeah so you'd sit down and they'd flip through the pages or they would tape all the pages and the window. And some of the old school Broker just still do that, right, I was up in a pentwater where I have my cabin. I actually think that's still cool, like to walk by the the old school, you know Pentwater broker up there and they just tape all the listings up in the area. You know, now there's LCD screens and TVs and all that stuff. But it's interesting because we think about we started from there and then everything started to go online and now all of a sudden, the consumer they can find their own home. And what was interesting is what did realtors do? They started freaking out, right, because all of a sudden all their power got taken away, like the consumer could just see the listing themselves. Ah, what am I supposed to do now? How am I supposed to get them here? But what happened?
Johnny Awesome:The realtors that really paid attention to what were happening and here's the key the realtors that have always understood that this is a service-based business. They still arrived because they built a community of people based on relationships that allowed them to continue to work. Oh, I wish I knew how to do that that allowed them to continue to work with people, no matter what it looked like or how the people got that information right. Right, so now we've gone online. People are finding the information themselves. We're in relationship with them, so they want to still use us because they still need a professional to get them through it, right?
Johnny Awesome:Well then we transitioned from that to you know, in like 2016, 2013 to 2016,. There was this big try of do it yourself, sell it real fast. You remember this era and this is where Redfin came out and they've been around forever, but they really started to shine like in 2016, when, all of a sudden, the idea of hey, you can just go online, you can kind of list it yourself. You still have a real estate agent that works for you, but you do most the work, right. And then you know, all of a sudden, there's all these discount brokers and there was then all this. That was the launch of the sell your house real quick with one button.
Jimmy Fantastic:Right, that only lasted a couple of years. Well, that was the same. That was the same time Rocket started coming. It was at the time it was in house Realty, was there? Well, they first came out was in house Realty, which then transferred. Now it's what we call rocket homes. But yeah, that was one Like. That was probably about that same time.
Johnny Awesome:And Zillow did the same thing. Remember, zillow was doing the same thing, so they. So we went to this like service yourself thing. That didn't last too long, but now we're getting into this really interesting part, right, it's almost like history repeating itself. I, I, this business guys, is it is so crazy cool, because think about this.
Johnny Awesome:Now, what's going to happen? I'm just being perspicacious here. Like, all of a sudden, we take all of our listings back, right, we, we disassociate from the large MLSs and all the politics that are going on, and you know, and all that other stuff. Right, this could happen, right, and then what does that mean? That means that we have that drawer again, right, however, instead of it just being me and you, if you're working with a company, again, keller's going to do this really well as well, and I, they've been working on it for a while, I know. And then we, of course, they just announced, you know, at EXP con, that we have that, um, the exclusive listing, whatever. So now, all of a sudden, like, there's a competitive advantage again, back to the real estate agent, right, like, so now we've got our digital drawer. It's just interesting to watch it kind of loop back around to where it's going to be like that again, but in the digital age, you know.
Jimmy Fantastic:Well, that's the thing, there's somebody always figuring something out, right, there's always there's some. There's somebody, you know, I, I was talking, I talked to uh, I was with Said last night and uh, and you know, again, his brain too, like it just goes to a different place, like, yeah, sometimes I'm like this dude, like it's like two steps ahead, and he's like, yeah, but I'm not. There's somebody four steps ahead, like there's. You know what I mean there's like, and so it was kind of cool because we kind of hit on this last night a little bit, um, and we, hey, and I talked about it when we were in Vegas too is is how this, like you know, with EXP, buying showcase IDX, yeah Right, I mean, they just bought showcase IDX and now there's 90,000 agents with an EXP that are going to have exclusivity with showcase IDX or the possibility of it.
Caller:Right.
Jimmy Fantastic:We don't know what that's going to turn into. But it goes back to your drawer thing. Yeah, right, because now and again, if I'm going to, if I'm going to, if I'm an agent and I want to look at a brokerage, I want to look at what's going to give me the most leverage, right, right, I want to see all right, if I go there or there or there there's let's say, there's five that I'm trying to pick from, I want to pick with the one that's got the biggest drawer. Right, you want to mean I want to go, the one that's got going to give me the most opportunity to have the most houses to sell or the most things, right, so it's going to change how that even looks.
Johnny Awesome:Whenever I've bet up against another realtor. Or I said I guess we're going to have to start staying real estate agents. Yeah Right, typically I'm the one with the biggest drawers. Yeah, that was an underwear joke, I know, all right.
Jimmy Fantastic:Everybody just went silent on that.
Johnny Awesome:Anywho.
Caller:Hey.
Johnny Awesome:Is it this one? There you go, yeah.
Jimmy Fantastic:I was going there, but no, so it's off medicine. It's going to get. It's going to get competitive in a different way.
Johnny Awesome:Yeah, so what's going to be? But here's, okay. So now let's talk about an ethical thing, cause this has got me all fired up. Y'all, let's talk about this. And you're right. She's right, exp has big drawers. Yep, let's, let's talk about this. So here's where. Here's where it's going to get interesting, though, because if we don't share everything with everybody else, right, then it does. There is an argument to be made that there is a disservice that ends up happening for our client. So, for instance, if we do have a, let's say that me and you decide that we're going to start our own cause, we could. Awesome association of realtors, fantastic association or whatever, right, the, the AWS, faa right, let's do it and start our own board.
Johnny Awesome:Yeah, and let's do everything we hate. Yeah, that's how it started, guys. Two dudes in a podcast said I got no idea.
Jimmy Fantastic:Let's call ourselves the national association of realtors, and then trademark everything, trademark it, yeah, so uh, but we could do that.
Johnny Awesome:But if we said, all right, now we've got exclusive listings between us, right, but we don't then show those listings to everybody, then what ends up happening is we're actually doing a disservice to our client, right? So that's going to be the interesting part with those ethics.
Jimmy Fantastic:Now, uh, now yes, and no right, because you think about the, the, the being exclusive. If the exclusivity part of saying right, uh, any brand, right, take any, any brand.
Johnny Awesome:All right, sure All right.
Jimmy Fantastic:Now, now you okay, so Kleenex. Kleenex is a brand.
Johnny Awesome:Yes, they are a brand.
Jimmy Fantastic:Yeah, it's not actually you're. You're. You're not actually buying Kleenex, you're buying facial tissue. That's not Kleenex, it's facial tissue. Kleenex is the brand Correct, right? Yes, so, but you can buy that anywhere, facial tissue, right? If you want Kleenex, let's say Kleenex just had their own store.
Johnny Awesome:Let's go one bigger, so one. What have you guys noticed that Walmart and Kroger right now are at this? Uh, they're doing this really cool thing where they're starting to license exclusive um items from the big brands. For instance, I believe it was either, I believe it's Kroger now that just picked up McDonald's chicken nuggets so you can actually buy McDonald's chicken nuggets at Kroger, and Wendy's got picked up by Walmart so you can buy Wendy's chili in a can at Walmart. So these big brand stores are starting to buy those name brands, just like you're talking about, and make them exclusives in their store. I like this.
Jimmy Fantastic:Okay. So now it was let's, let's get, and so and I didn't even think of, like, my thing was like Nike, yeah, right. So Nike has their own brand stores? Yes, but you can also buy Nike at that foot locker, right, right. So, so, but so, but a word do I want to go get it? I want to go get it from Nike, like I want the. I want to go get. I want to go to Nike, I want to. I feel better, I feel like it's a better product, I feel like it's a better brand, I feel like it's a better thing when I go directly to that place, do you?
Johnny Awesome:do you really?
Jimmy Fantastic:I do, I like, I feel like it's like I feel like, well, the ones they're given to the foot lockers and probably aren't constructed the same as they are if I go to the Nike thing, do you really?
Johnny Awesome:is that a true thing? Is that what's happening right now? It's perception, yeah, but is that true? Are you? So you're saying that Nike Nike ships real Nikes to their Nike store but like the reject Mikey's to foot locker?
Jimmy Fantastic:not well. So there's levels to this right. There's Nike levels yeah.
Jimmy Fantastic:There is because. So foot locker gets a specific level and foot locker gets different color runs than foot action does, and they get different color runs than Dix does. Like you can't buy the same color of Nike running shoe at foot locker and at Dix Like foot locker gets their exclusive color run and Dix gets their exclusive color run and foot action gets their color run. Now it's the same exact shoe, just different colors. So if you want it in that specific color, you got to go to a foot locker to get it in that color. Wow, so this is my best. I worked at foot locker. This is my foot locker brain, yeah.
Jimmy Fantastic:Foot locker brain, yeah, so there's the title of today's podcast, but like and so, but they're also all our levels of of shoe right, of quality, because you can also go to the shoe carnival and get Nike. But you're saying it's different, it's a lesser. It's a lesser. It's not as good as the one you get from foot locker or the Nike store or the Nike store.
Johnny Awesome:Right, okay, okay, but now all right. Now let's relate that to homes, though. Yeah, so easy so you want to. Williams only gets red door homes. Exp only gets blue door homes.
Jimmy Fantastic:Well, no, I mean, you get that word. Where does your wholesaler go? Well, the wholesaler goes to fizzballcom. No, they don't go to fizzball. Nobody goes to fizzballcom.
Johnny Awesome:Well, they do. But just to look up to see.
Jimmy Fantastic:But so where did your wholesaler go? Well, we have a whole, let's just say, for instance, abc brokerage. Yeah, they have their own MLS. Okay, well, I'm a wholesaler, all right. That's the world I live in, right? So now they have a whole section of just wholesaling that I can go to. Okay, right. So because apparently, if we just pay enough money, with ethics grow out the window and you can wholesale whatever you want. But no shady console sailors. But but shout out to Prisha.
Johnny Awesome:Well, that's not it. Whatever, yeah, whatever, the time's gone.
Jimmy Fantastic:But but yeah, so like you could, you could compartmentalize your, your own MLS. Right Like this is where you go for hundred thousand to fifty thousand.
Johnny Awesome:Right, this is where you could do that, but again, okay, so. So the question was let's just go back to this. Yeah, let's just talk about a single family home. All right, three hundred thousand dollar, yep. Three bedroom, two bathroom and Partially finished basement. Right, well, we'll place that would. Would be what Clarkson or Waterford or something like that.
Jimmy Fantastic:That's way too cheap for Clarkson, or water for maybe, not water for, okay Cool.
Johnny Awesome:So let's place that somewhere with Waterford. All right, if I have that one listing and I put it in my pocket, right, we'll just say it's a listing that's in my pocket, but I'm only splitting it between my Association of awesome realtors and you have your fantastic association of realtors. If I don't also share that with you, then it's it's only giving that exposure to my limited right, right. Therefore, again, this goes back to ethics. Ethically speaking, if I'm supposed to do everything in my duty to get the home sold for the best possible price, plus what you know, the bed and do the best I can for my seller Like, if I don't share it everywhere I could possibly share it then I'm not doing the best I can. Just so I can, you know, stick it to the man you know what I mean right, right, so that's where like, but that's a shoe analogy.
Jimmy Fantastic:But that's where that also comes into the point of like if I have, if I have the most agents in my awesome Association of realtors here.
Johnny Awesome:This is fantastic, bro, don't steal mine. Yeah that's awesome, awesome, association realers triple.
Jimmy Fantastic:Coming soon. Well, it is your one a away, that's the phrase Marketing 101.
Johnny Awesome:Right, there's your pitch line, your one a way have my fantastic brokerage.
Jimmy Fantastic:Yeah right, or my fantastic association realers yeah, and, but I have the most agents yeah, then. Then if I'm a consumer, I want my three hundred thousand dollar house in Waterford to go in front of the most. So it should be easier for me to get that listing because I can say I have.
Johnny Awesome:Interesting.
Jimmy Fantastic:People yeah. Interesting, okay, you analogy goes to like well, awesome, association of realtors, yeah, yeah, they're exclusive, right, right, my million dollar house, I want to go there.
Johnny Awesome:Well, the other thing too, with the wording or their luxury. Yes, yes because I well and that was the one thing that I picked up on the advertisement For that, for the exclusive listings, is like when somebody doesn't want it announced to everybody that they're listing their home. Well then, you have this exclusive network that you can sell through happens in the luxury brand right Right, right.
Jimmy Fantastic:No, homes typically don't, like you know. Look, we've, we've been in celebrities houses and whatever else. But like they, like they don't. They don't want looky-loos and tire kickers walking through their three million.
Johnny Awesome:They don't want click Detroit for to show that their house just went up for sale, right Like you know what I mean.
Jimmy Fantastic:Like they, just like you know. I remember when, when Matt Stafford's house, you know hit the hit the market here and everybody's like, oh, can we go? Can you take me to go look at it? I'm like no, you can't take you to go. Like it's a 20 million dollar house. What are you talking about, you know? Like no, you can't just go wander in there, start meandering around the house taking photos, right Selfies yeah, no, it's appointment only and you got to be pre-approved.
Johnny Awesome:Oh, I was so many realtor.
Jimmy Fantastic:Yeah, why are there so many showing time?
Johnny Awesome:just went crazy but you know what's. But see again, there's a good example of, of a rule, because, technically speaking, right, and I and I've actually had this conversation before with a couple luxury listing agents right, and they, they refused showings to realtors that requested realtor preview, mm-hmm. Now again going back to terms and conditions that we all sign into, especially here in Michigan, when we go into real comp Realtor previews, any realtor with their license is supposed to be able to do a realtor preview on any property. That's part of the, that's part of the gig, right, Right, you're not supposed to be able to say yeah, we're not gonna. Well, you know, you got to show that you're actually interested first. It's not supposed to be happening, right, right, but it does and yeah, it's it's something, man, yeah there's.
Jimmy Fantastic:I mean everybody toes the line right, but like that's the thing, but like so that that's where it'll get.
Johnny Awesome:Why that was so funny is like what told the line. I don't know.
Jimmy Fantastic:I just Brain today I cough right into.

Johnny Awesome:I don't, I don't know all the facts, I just want to join the people that are fighting, just so I can argue with somebody. I guess I Like what's happening there. Good morning, randy Gammo says good morning this morning. So, yeah, so you know again. But no matter what happens, no matter what happens, it does go back to what we want to talk about, and that is this industry is always changing. Now, with technology, it's changing faster and faster and faster. Right and again the boards. Boards were created, boards are going the other way, right Like this is what happens. But At the end of the day, this business is, and always has been, a people business. Yeah, we again in the early, you know, 80s, going into the 90s, when somebody had to use you like the people that climb the yes ladder right.
Johnny Awesome:46 yeses, 46 times right. You had him in the middle ABC, baby, abc, yeah, yeah. Like when, when that was all happening, it still was the people that realized that this was relationship. There's a, there's a fantastic book. And good morning to you as well. Oh, there's somebody we haven't, I haven't talked to in a really long time. It's your mom.
Jimmy Fantastic:Oh, I'm a yeah.
Johnny Awesome:Yeah, she's. We haven't actually had her live on the show either, just because I haven't been live on the show long enough to say good morning to her. Well, there was a fantastic book. I'll never forget talking to this author and boy guys. I wish that my head was Uncongested so that I could think, but I know the book is called prospecting with soul and it's a book that I recommend to a lot of real estate agents out there and it's an older book now I think it came out like maybe 2010, 1112 somewhere around there.
Johnny Awesome:But I actually had lunch with the author and we sat down and we were talking. There was a convention real estate convention that I was at and she was one of the speakers, and it wasn't even one of the main speakers, but I recognized her because I knew her book, because I was very educated in books. So I went and grabbed her. We ended up having lunch and just chatting and she said the most incredible thing and I love this and this was right when we were starting to switch from people really getting it, because the coaching in this industry Always seems slightly like lagged, like somebody goes out and then like for five years, they absolutely dominate by doing this play.
Johnny Awesome:And then they're like, oh, I could start coaching on that. Well now, by the time they start coaching on it now, it's taking them two years to get their platform off the ground right. And then all of a sudden, like ten years later, they're saying this is the only way to do it. And you're still handing out coupons to the red X, which is a really old program Not that there's anything wrong with that and not that doesn't still work.
Johnny Awesome:But there's other things. So we were right at that end where people were starting to understand, hey, we're in a relationship business and in the book prospecting was Ooh, that's a good question, we're we'll ask that in a second when it comes to Prospecting with soul what that book was all about. It was all about not hard-selling people but being in relationship with people. You were actually prospecting for people by building Relationships. And when we were sitting down I remember her telling me she goes you know, this book is, it's taking a really long time for it to get off the ground. It's taking a really long time for it to sell a bunch of copies. She goes if I wanted this to be a best-selling you know, like a number one best-selling of whatever she said I could put a title on there like the prospecting secret you need to know to be in control of your client, you know she's like some really hardcore like title.
Johnny Awesome:She said because that's what everybody's selling right now and that stuff sells really fast. But it all comes back to relationship. And now you know, 10, 12, 15 years after having that conversation with her, whatever it's been, now we've all, everybody's all like oh, we should have built relationships with all these people.
Jimmy Fantastic:It's too nice for sales right instead of just burning through.
Johnny Awesome:All right, all right, we got a. We got a question on.
Jimmy Fantastic:Which is way like. So the old school way that that that way was is way harder for people to grasp. Because, because it's not nice, like, it's not, like, it's not relationship, it's not. It's not just having conversation, it's sell, sell, sell, sell. You know what I mean? Like, and everybody wanted to do that and it felt good. It was like they watched all the movies and that's the problem. I want to do that it's like no, you don't, because you're not and you don't want to do that right.
Johnny Awesome:Yeah it looks. Yeah it looks fun. Dude, you're listening to all the. You know. I remember listening to the horse prats of the day.
Johnny Awesome:And yeah, yeah, it looks cool, doesn't it? And then everybody's in jail. But no, like the the thing is, is you there and there's people that are still trying to do this today. You're just constantly buying your business instead of being in relationship with your business and some of these big organizations you know, we know personally, and some of the big people at the top now. I remember talking to their leadership and like they're like we had to turn this entire ship and start realizing that, like our Database is a bunch of people that if we had relationships with, we wouldn't have to constantly buy the business right.
Johnny Awesome:So they were like we're huge ships that we're turning right, so it it always comes down to relationship. This, this is an ethic, this is a. This is an interesting, this is an interesting question here. So Jessica comes in because we were talking about ethics. So, again, this is going back to the ethics of If I had my own listing system and you had your own listing system, I believe and she says ethics wise, could that be considered steering? So do you mean it would be considered steering in? In which way, jessica? You mean?
Jimmy Fantastic:for yes, star, star, I'm you yourself. Yes.
Johnny Awesome:Yeah, let us know. Here I'll turn this on.
Jimmy Fantastic:Yeah, let us know star, star, I'm you yourself. And then Exactly what?
Johnny Awesome:because I'd love to have a conversation about that. Johnny Awesome:Again, you know, I think so. I mean again, it's a rough area because it's it's tooth that reason.
Jimmy Fantastic:Same thing is the Very similar to the love letter right Like it's a very, it's a very gray area.
Johnny Awesome:Well, that's not a gray area.
Jimmy Fantastic:You're not supposed to do it when, though not everywhere, like it's what I mean. We can do them here the love letter.
Johnny Awesome:Yeah, they literally said we're not supposed to be doing those, we're in Michigan. No, they haven't. Yeah, they have, because it's against the fair housing. It's a fair housing violation. We did a whole episode on this?
Jimmy Fantastic:No, but no, that was remember. There was that Michigan had, unless the. You know something, I don't know that that time we talked about it that Michigan still hadn't. I'm still getting them on my listings.
Johnny Awesome:Yeah, well, well, is it okay, let me and again, but now.
Jimmy Fantastic:I'm not supposed to show them.
Johnny Awesome:Right, yes, yes, yes, yes, yes, somebody can write it, yes.
Jimmy Fantastic:Yeah, but at the same point, like I mean but if I'm just saying, hey, like this is my family, right, that, but that's where it's a fair housing violation, right, because then yeah, but there's a gray line there, right, like there's, there's a lot of, I can say this, but, or I don't, but I didn't mean it. You want to mean, like there's a lot of, it's just like laws, right, they're either hard and fast or they're not. Yeah, right now, it's like a speed limit, right, if I'm, if I go five over, cops don't pull me over because they don't want to Write the ticket for five over right, depending where you are same thing with the love letter, like you know, you know, did it maybe, I don't know, did it make a decision that I don't know?
Jimmy Fantastic:You know, I mean, there's a very hard proof. It's very hard to prove that they were bad unless they're actually bad. Do you want to mean like an unless it jazz I'm, I.
Johnny Awesome:Well, there's a lot of Okay, so hang on back You're having a hard time processing what I'm saying, but no, I get you. Yeah, but I just want to. I want to back up just for a second so we can revisit this conversation from two years ago. By the way, yeah, it was the Department of Justice, something, something because one of our first podcast.
Jimmy Fantastic:Yeah, because at the time we talked about it, oregon was the first one to outlaw completely.
Johnny Awesome:Yes, oregon said done, we're done with the love letters, we don't want them anymore, we're done with them and the reason behind that is this guys, if you here's why, alright, so let's just reopen this up by a little bit, if you send somebody.
Jimmy Fantastic:The funny thing is it's part of this whole lawsuit it is it's part of it's still going on in this whole thing.
Jimmy Fantastic:That's what, and and actually we were a year late to the lawsuit. The lawsuit's like three years old. Yeah, yeah you know, I mean we were like. We were like we haven't started the podcast. That right that's. I mean like that's how long is so for everybody that's listening, though that like it's how long this Things went going on. Yeah, they've been, they've been this has been like how many millions of dollars have been spent one and how I'm then again, how crazy, how fast and crazy is it gonna get.
Johnny Awesome:But here's the thing about the love letters, guys. So the problem with the love letters is this if, if you have a lot, if you, if you have a client that writes a letter, especially if they're saying something like your house is the best house ever, I can imagine my family living there. And blah, blah, blah, blah, blah Especially if they say something like this, this becomes a fair housing Issue, compliance issue. Why? Because your seller is not supposed to discriminate Against people that do or do not have families, race all the stuff that is protected under the fair housing right. So if they choose to pick one family over another so let's say, if there's an older couple that wanted the family, right, or family that wanted the house, they didn't have a family.
Johnny Awesome:But then they get this love letter about how the kids can be seen Swinging in the tree in the backyard and the pot, playing in the pond and catching frogs, and the couple that's selling the house Goes oh I want to see a family grow up here, that's what I want. And so they picked that offer over the other people's offer. Well, that's a discrimination issue, right and because that was happening so much. That's what got. That's why it was written into this whole DOJ thing that we talked about forever ago when we did that episode, which is called illegal love letters. By the way, you can look it up anywhere. You get podcasts or if you're listening this podcast live, you just scroll all the way down to the bottom. It was one of our first ones a while ago and what happens is.
Johnny Awesome:So Oregon, for instance, some of these other states, just said, in order to stop this from happening, we're just just gonna tell people you can't, you can't give them on to the seller anymore. Right, because the seller, you're putting them in a really Bad position by making them now feel attached to this person, like they actually want to give them the home. Yeah, right, so you got to be really careful with that stuff. So, again, if the seller, just to be clear, you know, and we're not attorneys, check with your attorney, or blah, blah, blah, blah, we never everything that we say is for entertainment purposes only.
Johnny Awesome:This isn't even real. That covers that, but that. So it is a very it's not a gray line at that point in time.
Jimmy Fantastic:If somebody's picking somebody, you know family versus not family, it's a it's a that's a hard line, that's a hard like don't do that, yeah, and then it's funny too. So so it's just so weird how all these lines Cross over. So I was just having a conversation with somebody about the VA loans Right now. A lot of times people all interesting like they'll be like oh, I don't want to take the VA loan because they want to do all these things and blah, blah, blah, blah, blah, blah, blah, blah, blah blah, that's okay.
Johnny Awesome:Yeah.
Jimmy Fantastic:I'm like huh, like no, that's not okay. And but then I've had the other thing happen. They've accepted an offer because it was a VA loan, because the guy was a veteran. Yeah, yeah, I want that because that's a VA loan.
Johnny Awesome:Yeah.
Jimmy Fantastic:I'm like well, that's not discriminatory.
Johnny Awesome:I is, and I don't know the answer. This I know. I know it's on here is is, is VA? Is that a? That is that a protected class Like can use? I would love to know that. Does anybody does? I mean I don't, I don't have the answer to that yeah, I don't either.
Jimmy Fantastic:I know it's just, it's funny because, like it's, you know, when you start talking about this, right wrong.
Johnny Awesome:Yeah, where is like all these things I want to?
Jimmy Fantastic:know that I think that cuz like and I I feel it's. I feel it's hard because if, like, I love our veterans, right, I'm glad they went and served and I yeah so I think the VA programs. I love the VA Product.
Jimmy Fantastic:Yeah yeah, it's a government back loan like there's no more solid loan in the VA loan, fha, va loans, yeah, they're good, they're solid loans, like yeah and and. But then why, when people turn them away or like even an FHA loan, yeah, how do we, how do you, how do you? How is that not discriminatory when I say, huh, I'm not taking a little like and you can even average, you? And the crazy part is, when you put your listing up, you can decide what kind of things you're taking on it. Well, I can say cash, conventional only.
Johnny Awesome:Yeah, but we're talking about, we're talking about People at that point in time, right like we're not. Not, we're not talking about people, we're talking about. There we go. Caller:Hey, how's it going guys? Good, good, I just want to chime in before I have to hop off the call, because this is a really important conversation and I think that you know the talk about love letters and ethics and a lot of this stuff that you know seems a little more nonchalant then. Then you know, to some of us newer agents who are really really going through the process of being educated by our brokers all the freaking time about this stuff, if you get a love letter in an offer you know, like you're you have a listing and your agent attached a love letter to it and mailed it to you, you're supposed to call your board and report that. As a realtor these days you are not supposed to help in any capacity for your buyers to Present that information. You know they stick base, might stick it in the mailbox. They might have heard from their friends that it helps and it's helpful. It's been helpful maybe historically, but as a realtor it is Against ethics. It's an ethics violation for you to actually attach that to your listing and send it along. And I think it's really important because not only does it put it in the seller's head, it puts it in your head first and I know that when we have like 200 offers in front of us and there's that one with this love letter that you're gonna read and you think in your mind you don't have to tell them, there's a much higher chance that that whole love, love letter and whatever they put in there is gonna translate itself In some kind of way. Conversation might slip, whatever it is. So you're really supposed to just, you know, report that to some degree and I think that's what's gonna help over time to kind of stop that from happening.
Caller:And then you talked about VA loans and I work with a lot of VA buyers here in New York and it's really, really important to me. But the reason why it's not part of race, sex, you know, family and all of that status is because it pertains way more to the actual Financing of the whole thing. And as realtors we want to present as buyers, agents they're financing, so saying that they have gainful employment and that they they're presenting a veteran's loan. You know, you can say you know that they were active in whatever. I don't think that that's against any kind of violation or anything, but you do have to present the loan itself and by showcasing that it is a VA loan in your email offer. That does not, you know, violate anything. So I just wanted to say that because I still get them all the time. I know everywhere across the country there's that one agent who maybe you know, had their secretary doing their ethics classes for them.
Caller:And you know like you still get them, but you're supposed to report them, and for good reason, I think so. That's, that's really all I want to say Awesome.
Johnny Awesome:Well, thank you very much for sharing Absolutely. And again I would like to point out, you know, again, we are, we are in 38 different countries. The podcast airs, so we're not attorneys and people's opinions, so on and so forth, are not necessarily law. Because this is really interesting, because Sandy also queued in here, I'll key this back up and she actually says that the federal housing laws, vas are not a protected class. But under Virginia, va is a protected class, so it also state by state could be different too. So you want to definitely check state by state to see who is and isn't a protected class.
Johnny Awesome:Again, you know, one of the one of the reasons that the show exists and we have conversation we love having conversations with you guys because this might be stuff that you'd never thought of before. And now you're like whoa, I didn't even realize, like I wasn't supposed to shoot. I remember back in the day when I actually had a broker tell us, you know, going back to the love letters thing, she was just saying, yeah, like we used to write them, not me, but like the broker used to be like, well, you can actually write the letter on behalf of your client. Yeah, yeah, paperclip of a picture of the family.
Jimmy Fantastic:Yeah, that was.
Johnny Awesome:That was Al talked about that spray some perfume on it and send it on.
Jimmy Fantastic:Right, I'll talk about that, about putting family photos with the love letter and sending it.
Johnny Awesome:Yeah, yeah, yeah, gotta you know again. You got to know you know. You got to know your laws. You got to know what you are and aren't supposed to do. But then, going back to what you said in the very beginning, though, because this is where this is gonna get interesting, y'all. Okay, what makes that a rule? Quote-unquote is that even a law? Right? It's not a law, folks. What that is is it's a NAR guideline, correct? What happens when you don't belong to NAR, right? What happens if you're just real or you know?
Johnny Awesome:I remember when I first got in this business, the gentleman that sold the building to where our real estate, when I was at Keller Williams. He was, he was a broker, but he didn't subscribe to NAR, he subscribed to one of the other. I don't even know if he subscribed to anything. He was just a real estate agent with a broker's license, right, and he never put anything on the MLS. He was like, why do I need that? I've got Zillow and everything else. He would just call agents.
Johnny Awesome:So, like, if you're in that type of situation, like again, then all of a sudden it brings up a whole but and what's funny here's, here's what's gonna happen. Possibly this is just for funsies in my brain. So we're gonna go all the way back and be like, oh, let's leave NAR and all their rules are stupid. Now, now we're sending love letters and all this other stuff again, and now there's huge discrimination and somebody's gonna go. You know, this is kind of out of control. What we need to do it started an organization to which people subscribe to so that this stuff doesn't get out of control, and then we'll put these rules in place.
Jimmy Fantastic:And you know what then, like 25 years later, Well, the other crazy, the crazy part about this thing, too, is one of the things that they can't agree on between the DOJ and NAR. Is the DOJ because NAR has their board right. Yeah, it's voted on by our members, and if you don't know that, you have a voting right and are you do? Yep, I don't know if you know who you're voting for. I mean, like, if you look at the people that are representing us in Washington, I don't know them. Yeah, you know what I mean. Like, it's just like I don't know whatever. But but part of the part of this lawsuit, too, is the DOJ Said they wanted a person from the DOJ as a seat on the board of.

Johnny Awesome:Number one you do need to pay attention to what's happening out there, right, like, pay attention and listen to the news that's happening, because it is going to directly impact you and there's also opportunities for you to directly impact it.
Johnny Awesome:But the number one thing that you're gonna do to protect your business, no matter what happens with NAR and if the association goes away and if everybody's sending love letters and you have to spray perfume on every Letter of acceptance nowadays, whatever weird thing comes up the number one thing that's gonna protect you and make sure that you always have a stable business is by building a community of people Through which they want to use you as a service person, in other words, create a giant group of relationships. So, no matter where the world goes, if you're not a realtor anymore, it doesn't matter to them. If you're just a real estate agent, that doesn't matter, because you have built the relationship with them and they're going to allow you to represent them, no matter what happens with all the other designations and all the other organizations. Right, build your relationships, build your crew of people underneath you that are gonna know you, like you, trust you and promote you, and Everything is going to be fine.
